Service Agreement & Liability Waiver

This Service Agreement & Liability Waiver ("Agreement") is entered into by and between Santa Barbara Dog Jog, LLC ("SBDJ") and the undersigned client ("Owner") regarding services provided for the dog(s) identified in the accompanying intake materials.

By checking the acknowledgment box and submitting this form, Owner confirms that they have had the opportunity to review this Agreement and agrees to the terms below.

1. Services

SBDJ provides dog-related services including, but not limited to: private walks, jogs, hikes, group Adventure Days, dog training, transportation, day boarding, overnight boarding, in-home visits, overnight sitting, medication administration, and related pet care services

Services may be performed by employees, contractors, agents, or approved representatives of SBDJ.

SBDJ reserves the right to refuse, suspend, or terminate services at any time if a dog is deemed unsafe, excessively reactive, aggressive, uncontrollable, unhealthy, or otherwise incompatible with services at SBDJ’s sole discretion.

2. Owner Representations

Owner represents and warrants that:

  • Owner is the legal owner or authorized caretaker of the dog(s).

  • The dog(s) are current on legally required rabies vaccinations.

  • The dog(s) are physically capable of participating in requested services.

  • Owner has disclosed all known behavioral concerns, including but not limited to: bite history, leash reactivity, dog aggression, stranger aggression, prey drive, escape tendencies, anxiety, resource guarding, medical conditions, and prior attacks or incidents

Failure to disclose behavioral or medical concerns may result in immediate suspension or termination of services.

3. Assumption of Risk

Owner understands and acknowledges that dog-related activities involve inherent risks that cannot be completely eliminated, even when reasonable care and supervision are used.

Owner voluntarily assumes all risks associated with participation in SBDJ services, including but not limited to: dog bites, scratches, puncture wounds, dog fights, leash failure, escape, transportation incidents, interactions with unfamiliar dogs or people, wildlife encounters, rattlesnake encounters, foxtails, rough terrain, heat exposure, ocean and water exposure, currents and drowning risk, waterborne illness, contagious illness, ticks and fleas, physical injury, illness, permanent disability, death, and property damage

Owner acknowledges that some services may occur off leash, in public spaces, on hiking trails, on beaches, in unfenced environments, and in group settings. 

Owner understands that even well-trained dogs may behave unpredictably in these environments.

4. Off-Leash & Pack Adventure Activities

Owner acknowledges that Adventure Days and certain group activities may involve off-leash participation in unfenced areas.

Owner expressly authorizes SBDJ to allow their dog to participate in off-leash activities where deemed appropriate by SBDJ.

Owner understands that off-leash activities involve elevated risks including escape, injury, dog fights, wildlife encounters, environmental hazards, encounters with unfamiliar dogs or humans, ocean-related hazards, and transportation between locations

SBDJ reserves sole discretion to determine whether a dog is suitable for off-leash or pack activities.

Owner may revoke off-leash authorization in writing at any time; however, SBDJ may limit or discontinue certain services if off-leash participation is restricted.

5. Transportation Authorization

Owner authorizes SBDJ to transport dog(s) by vehicle for the purpose of providing services.

Owner acknowledges that transportation may occur to parks, beaches, trails, boarding locations, training locations, or veterinary facilities

SBDJ may use crates, harness restraints, seatbelt attachments, or other reasonable transportation methods at its discretion.

Owner assumes all risks associated with transportation.

6. Veterinary Emergency Authorization

In the event of illness, injury, or emergency, Owner authorizes SBDJ to seek veterinary care for the dog(s) if Owner cannot be reached promptly.

Owner authorizes SBDJ to approve any treatment reasonably necessary for the immediate health and safety of the dog(s).

Owner agrees to reimburse SBDJ for all veterinary expenses, transportation expenses, medications, emergency care, and related costs incurred on behalf of the dog(s).

SBDJ is not responsible for outcomes resulting from veterinary treatment, emergency transportation, or delayed owner response.

7. Training Disclaimer

Owner understands and acknowledges that dog training outcomes cannot be guaranteed.

Behavioral progress varies based on factors including: consistency, owner participation, home environment, dog temperament, prior experiences, genetics, medical conditions

SBDJ makes no guarantees regarding: obedience, recall, socialization, aggression reduction, behavioral modification, compatibility with other dogs or people

8. Equipment

Owner agrees to provide safe and properly fitted equipment.

SBDJ reserves the right to replace unsafe equipment during services.

9. Payment & Billing

Payment is generally due before services begin.

SBDJ may accept payment through Venmo, Zelle, invoices, or other approved methods

Packages are non-refundable.

Unused services expire after six (6) months and may become subject to updated pricing at SBDJ’s discretion.

Business-contracted services may be invoiced separately.

10. Cancellation Policies

Standard Services

Sessions canceled within 12 hours of the scheduled start time will be charged the full amount.

Boarding Services

To reserve boarding services, a deposit equal to 50% of the total booking cost may be required.

If cancellation is provided before 12:00 PM PST seven (7) days prior to the booking start date, boarding payments will be fully refunded.

If cancellation occurs after 12:00 PM PST seven (7) days prior to the booking start date, 50% of the total boarding fee will be retained.

Weather & Safety Cancellations

SBDJ reserves the right to shorten, modify, reschedule, or cancel services due to: excessive heat, wildfire smoke, unsafe trail conditions, storms, natural disasters, environmental hazards, safety concerns.

When SBDJ cancels services for safety reasons, clients will receive either: a credit, rescheduling option, or other reasonable accommodation at SBDJ’s discretion.

11. Home Access Authorization

Owner authorizes SBDJ to enter Owner’s home or property as reasonably necessary to provide services.

This authorization may include use of: keys, lockboxes, garage codes, smart locks, hidden keys, gate codes, other access methods provided by Owner.

Owner acknowledges that SBDJ takes reasonable precautions regarding storage and handling of client access information.

SBDJ shall not be liable for: theft by third parties, alarm malfunctions, pre-existing property damage, acts of unrelated third parties, losses beyond SBDJ’s reasonable control.

12. Media Release

Owner grants SBDJ permission to photograph and/or video the dog(s) during services.

Owner grants SBDJ the right to use such media for: marketing, social media, website content, promotional materials, business operations.

Owner may revoke media authorization in writing.

13. Limitation of Liability

To the fullest extent permitted by California law, SBDJ’s liability for any claim arising from services shall be limited to the total amount paid by Owner to SBDJ during the thirty (30) days preceding the incident giving rise to the claim.

SBDJ shall not be liable for: indirect damages, consequential damages, emotional distress, lost profits, punitive damages, special damages.

Nothing in this Agreement is intended to waive liability for gross negligence, recklessness, or intentional misconduct where prohibited by law.

14. Indemnification

Owner agrees to defend, indemnify, and hold harmless SBDJ and its owners, employees, contractors, agents, and representatives from any and all claims, liabilities, damages, losses, injuries, costs, or expenses arising from: the behavior of Owner’s dog(s), undisclosed behavioral history, dog bites, dog fights, property damage, injuries caused by the dog(s), third-party claims related to the dog(s) including reasonable attorney’s fees and legal costs.

15. Attorney’s Fees

In any legal proceeding arising from this Agreement, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs.

16. Governing Law, Venue & Mediation

This Agreement shall be governed by the laws of the State of California.

Before filing any lawsuit or legal proceeding arising out of or relating to this Agreement, the parties agree to first attempt in good faith to resolve the dispute through mediation.

The parties shall mutually agree upon a neutral mediator located in Santa Barbara County, California, or, if the parties cannot agree on a mediator, shall make a good faith effort to select a qualified mediator through a recognized mediation provider.

Each party shall participate in mediation in good faith. Unless otherwise agreed in writing, the parties shall share the mediator’s fees equally.

If mediation does not resolve the dispute, any legal action arising under this Agreement shall be brought exclusively in Santa Barbara County, California.

17. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, understandings, or representations.

Any modification must be made in writing.

18. Acknowledgment

By checking the acknowledgment box and submitting this form, Owner acknowledges that they:

  • have read this Agreement fully

  • understand the risks involved

  • voluntarily agree to all terms

  • understand that participation is voluntary

  • understand that dog-related activities carry inherent risk
